Fine Art Print Sales – Fabien Courtitarat, photographer, artist & author

1. Scope

These General Terms and Conditions of Sale govern the sale of original photographic prints created and offered by Fabien Courtitarat, photographer, artist and author.

2. Legal Status

All prints are sold under the artist-author legal status, as defined by the French Intellectual Property Code (CPI, article L.111-1 et seq.).
They are offered as original works in limited editions (maximum 30 copies, all formats included), in compliance with French Tax Regulation (article 98A, Annex III, CGI).
This activity is not considered a commercial business under French Trade Law.

3. Products

Each print is:
– signed and numbered
– limited to 30 copies total (all sizes and supports combined)
– delivered with a certificate of authenticity

Colors may vary slightly depending on screen and display calibration.
Paper type, format, and finishes are specified on each product page.

4. Pricing

All prices are displayed in euros (€).
As an artist-author, I am not subject to VAT, in accordance with French regulation (article 293B, CGI).
Shipping costs are calculated separately and added at checkout.

5. Orders

Placing an order implies full acceptance of these terms and conditions.
The author reserves the right to refuse any order in case of payment failure or abusive behavior.

6. Payment

Full payment is required at the time of order.
Accepted payment methods include: credit/debit card, PayPal, Apple Pay, and Google Pay.

7. Print Production & Delivery

Prints are produced on demand in a professional printing laboratory.
Estimated production time: 7 to 15 business days.
Delivery is handled by a third-party carrier (Colissimo, UPS or equivalent), or via local pickup around Aix-en-Provence / Marseille upon request.
The author cannot be held responsible for delays caused by the carrier.

8. Right of Withdrawal

In accordance with French Consumer Law (article L221-28):
Made-to-order or personalized prints are not eligible for withdrawal or cancellation.
For prints exceptionally available in stock, customers may request withdrawal within 14 days of reception.

9. Claims & Returns

In the event a print arrives damaged, reporting is required within 48 hours with photos of the parcel and print.
A replacement or refund will be offered depending on the case.

10. Personal Data

Collected personal data is used exclusively for order processing and delivery management.
No data is shared with external parties beyond essential services (hosting, payment, delivery, print production).
No data is sold, transferred, or used for unsolicited marketing.

11. Governing Law

These terms are governed by French Law.

12. Mediation

If a dispute arises, consumers may access the following independent mediation service free of charge:
